(re) Acquisition of Romanian citizenship

Necessary documents for former Romanian citizens who lost this citizenship for reasons not attributable to them or to whom it was revoked without their will, as well as for their first, second and third degree descendants.

REQUIRED DOCUMENTS
  1. two recent color photos format 3.5 cm X 4.5 cm
  2. The passport, in original and in copy (with translation, as the case may be) legalized;
  3. Identity card or identity card, in original and certified copy;
  4. Criminal record from abroad in original and with translation into Romanian, legalized, if applicable.
  5. Civil status documents (birth, marriage, death or divorce certificates) in original and in legalized copies for the holder and ascendants (parents, grandparents, great-grandparents), former Romanian citizens and with translation into Romanian, legalized, if any the case;
  6. Declaration on one’s own responsibility, authenticated at the notary or at the diplomatic mission of Romania, from which to result if one wishes to acquire the Romanian citizenship by keeping the domicile abroad or establishing the domicile in Romania;
  7. Declaration on one’s own responsibility, authenticated at the notary or at the diplomatic mission of Romania, showing that at present it does not undertake and does not support actions against the rule of law or national security and in the past it has not carried out such activities;
  8. Declaration on one’s own responsibility, authenticated at the notary or at the diplomatic mission of Romania, from which it should result whether or not he submitted another application for acquiring Romanian citizenship;
  9. Civil status documents in original and in legalized copies for the minor children of the applicants and with translation in Romanian, legalized, if applicable;
  10. The agreement of the parents for the acquisition of Romanian citizenship by the minor children, given by an authenticated declaration to the notary;
  11. The consent of minors over 14 years of age for the acquisition of Romanian citizenship given by a statement authenticated at a notary in the presence of a parent.
IMPORTANT
  • There are no fees for submitting the file to the National Authority for Citizenship.
  • The documents will be submitted in a file with rail.
  • Applications shall be submitted in person and only in duly justified cases by supporting documents, based on prior written approval, by a proxy with a special and authentic power of attorney.
  • Applications can be submitted to the National Authority for Citizenship, to the headquarters in Bucharest or to the territorial offices of the A.N.C. from Iaşi, Galaţi and Suceava.
  • Applications can also be submitted to the diplomatic missions or consular offices of Romania in the applicant’s country of residence / residence, which will immediately send them to the Citizenship Commission within the National Citizenship Authority.
  • When registering the applications for regaining the Romanian citizenship at the A.N.C. or at the territorial offices, the applicants are obliged to present the document attesting the right of residence on the Romanian territory: the border crossing document (passport, travel document, etc.) or the short or long-term residence permit. The document will be presented in original and in copy, the latter being attached to the application.
  • When submitting the applications regarding the Romanian citizenship, the applicants are obliged to present the passport or the bulletin, in original and in legalized copy, all the civil status documents both in legalized copy and in the laminated (plasticized) civil status certificates are not accepted. the original documents were damaged by rolling.
  • Applicants (non-EU / EEA / Swiss Confederation foreign nationals) will attach to the file a simple copy of the passport file (s) on which the visa allowing entry into Romania is applied and / or the stamp applied by the border crossing points on entry into the territory of the country, in the case of nationals of States for which a visa is not required. In the case of third-country nationals holding a residence permit issued by one of the EU / EEA / Swiss Confederation Member States, it shall also be attached in single copy.
  • It is not necessary to apostille for documents from the Republic of Moldova and those from Ukraine.
The procedure for regaining Romanian citizenship art. 11

Romanian citizenship can be regained or can be granted to persons who were Romanian citizens and who lost it for reasons not attributable to them or to whom this citizenship was revoked without their will, if they meet the conditions provided by art. 8 lit. b), c) and e) of the Romanian Citizenship Law. This legal provision also applies to the descendants of former Romanian citizenship up to the third degree.

Thus, the applicants must be of legal age, must prove by behavior, actions and attitude, loyalty to the Romanian state, not to take or support actions against the rule of law or national security and to declare that they have not taken such actions in the past. . Also, they must be known to behave well and not have been convicted in the country or abroad for a crime that makes them unworthy of being Romanian citizens.

Applicants will have the opportunity to retain foreign citizenship and establish their domicile in the country or maintain it abroad.

Submission of the application

The application for regaining Romanian citizenship is submitted in person at the headquarters of the National Authority for Citizenship in Bucharest or at the territorial offices of the A.N.C. from Iaşi, Suceava and Galaţi. In duly justified cases, the request for regaining Romanian citizenship is submitted by proxy with a special and authentic power of attorney at the headquarters of the National Authority for Citizenship in Bucharest, based on a prior written approval.

Persons domiciled or residing abroad may submit the application for regaining Romanian citizenship to the competent diplomatic missions or consular offices of Romania in the country of domicile or residence.

After the submission of the application, the President of the Citizenship Commission will set the first term at which the Commission will verify the fulfillment of the necessary conditions for regaining the Romanian citizenship according to art. 11, a term that will be set at most 5 months from the date of registration of the application.

Also, at this moment, the President of the Commission orders by resolution, the request for relations from any authorities regarding the fulfillment by the applicant of the conditions provided in art. 8 para. (1) lit. b) and e) of the Romanian Citizenship Law. These reports shall be communicated to the Commission within a period not exceeding 60 days and, in exceptional cases, within a maximum period of five months from the registration of the application.
