Right to stay in Romania for a long time
If you are a citizen of a non-EU / EEA state, you have a valid right of residence in Romania and you want to obtain a long-term stay on the territory of this state in order to establish your residence, you must meet certain conditions.
The steps to follow are: request the granting of the right of long-term residence to the territorial formations of the General Inspectorate for Immigration in the county where you live, and if the answer is positive, submit the documents for obtaining the long-term residence permit.
You can obtain this right both as a family member of a Romanian citizen and for another purpose of staying in Romania (for example: work, commercial activities, family reunification, etc.).
COMMERCIAL ACTIVITIES
Are you a citizen of a state outside the European Union and the European Economic Area? Do you want to stay in Romania for a longer period of time and have your own business? You must be a shareholder or associate with the duties of management or administration of a company and obtain the specialized technical approval issued by the Ministry of Business Environment, Trade and Entrepreneurship (M.M.A.C.A).
Once you have obtained this approval, you can obtain a long-stay visa from the diplomatic missions and consular offices of Romania. (See their list).
LONG STAY VISA
To obtain a long-stay visa for commercial activities you must submit the following documents:
the specialized technical opinion issued by the Ministry for Business Environment, Trade and Entrepreneurship (M.M.A.C.A);
criminal record certificate or other document with the same legal value;
medical insurance valid for the entire period of the visa;
proof of accommodation conditions.
The visa fee is 120 Euros and is paid in the state where you apply.
All these documents are submitted to the diplomatic missions or consular offices of Romania.
As an internal procedure, the long-stay visa receives the approval of the National Visa Center only after obtaining the approval of the General Inspectorate for Immigration. The approval is issued within 30 days from receipt of the application, with the possibility of extending the deadline by 15 days.
The long-stay visa is granted for a period of 90 days, with one or more trips.
WORK
OBTAINING THE OPINION
Do you want to work in Romania and have the citizenship of a state outside the European Union and the European Economic Area? You need to find an employer and support the evidence required by it. If he decides to hire you, he will get a notice of employment. You can be employed in Romania by a single employer, natural or legal person.
The employer will obtain the employment permit from the territorial formations of the General Inspectorate for Immigration in the county where it has its registered office. For this, he will submit a series of documents.
Conditions for obtaining the approval
When issuing the employment notice, the employer will pay as follows:
- for the employment permit for permanent, posted, cross-border, trainee, highly qualified, au pair worker, the employer will pay the equivalent in lei of 100 euros;
- for the work permit for the seasonal worker, the employer will pay the equivalent in lei of 25 euros;
- the equivalent in lei of 25 euros if the employer intends to employ a foreigner holding the right of temporary residence for studies after graduation or for the holder of the right of temporary residence for family reunification, as well as in case of change of employer or position , to the same employer;
The receipt will be presented in original, with the signature and stamp of the treasury unit. In case the fee for issuing the employment / secondment notice is not paid to the treasury, on the documents by which the fee was paid, the State Treasury units will confirm, by signature and stamp, the collection of the respective amounts in the corresponding budget revenue accounts. If you do not have Romanian citizenship or the citizenship of another member state of the European Union or of the European Economic Area, you can work in Romania, with a notice of employment, if the following conditions are met:
- Vacancies cannot be filled by Romanian citizens, EU / EEA Member States or permanent residents in Romania;
- Meet the special conditions of professional training, experience in activity and authorization;
- Prove that you are medically fit to perform that activity;
- You do not have a criminal record that is incompatible with the activity that you carry out or are going to carry out on the Romanian territory;
- You are part of the annual quota approved by Government Decision;
- The employer has paid up to date the obligations to the state budget;
- The employer carries out activities compatible with the position for which the foreigner is required to be employed;
- The employer / beneficiary of services has not been sanctioned for undeclared work or illegal employment, in the last 6 months prior to the settlement of the application in the case of permanent / seasonal / trainees / cross-border / highly qualified / au pair / posted / ICT workers.
The provisions of point no. 1 above must not be met if you fall into the following categories:
- you hold the position of administrator in a foreign-owned company and you are the only person appointed to this position;
- you are a professional sportsman and you have proof that you have carried out a similar activity in another country;
- request an employment notice for cross-border workers;
- request a hiring notice for seasonal workers;
Studies

LONG STAY VISA
The long-stay visa for studies can be granted, upon request, to foreigners requesting entry into Romania as a student, trainee or student participating in a student exchange program or educational project. The institution where you will study can be state or private, provided it is accredited according to law. The visa is also granted to foreigners accepted for studies based on the international documents to which Romania is a party.
To obtain a long-stay visa you must submit the following documents:
1. As a pupil, master’s student or doctoral student:
- proof of acceptance for studies issued by the Ministry of National Education and Scientific Research, showing that you will follow a form of full-time education;
- proof of payment of the tuition fee for at least one year of study;
- proof of means of subsistence, in the amount of at least the minimum net monthly salary per country, for the entire period covered by the visa;
- proof of knowledge of the language in which the study program to be conducted will take place, except for the preparatory year of the Romanian language for foreign citizens;
- criminal record certificate or other document with the same legal value;
- medical insurance during the validity of the visa;
- the approval of the parents or guardian regarding the stay for the purpose of studies on the Romanian territory, if the foreigner is a minor.
2. If you participate in a student exchange program:
- proof of acceptance to study issued by the Ministry of Education, Youth Research and Sports, showing that you will follow a form of full-time education;
- proof of participation in a student exchange program, carried out by an organization established under the law and recognized for this purpose;
- proof from the student exchange organization that it will provide the means of maintenance and any costs of removal;
- medical insurance during the validity of the visa;
- proof of accommodation in a family selected by the student exchange organization and which has a living space considered normal for a family in Romania;
- the approval of the parents or guardian regarding the stay for the purpose of studies on the Romanian territory, if the foreigner is a minor.
3. In the case of trainees participating in an unpaid vocational training program:
- training agreement, written commitment of the host entity in the sense that, if an intern remains illegally in Romania, the entity is responsible for reimbursing the expenses incurred from public funds for the stay and removal of the trainee;
- proof of a higher education diploma in the last two years preceding the date of application or proof of participation in a course of study leading to such a diploma;
- proof of means of subsistence in the amount of at least the level of the minimum gross basic salary guaranteed in the country for payment for the entire period entered in the visa;
- proof of accommodation conditions.

Peculiarities of the study visa
Foreigners participating in a student exchange program must usually be between 7 and 19 years old. The foreign scholarship holders of the Romanian state are not obliged to prove the payment of the tuition fee and the proof of the means of maintenance for obtaining the visa, and those of Romanian origin are not obliged to prove the means of maintenance.
OTHER PURPOSE
Administrator
If you come as a director of a company, you must prove that you cumulatively meet the following conditions: you have the status of administrator of the company, at the date of application you are not associated or shareholder in the company in question or another Romanian legal entity and you did not have these qualities in the last 2 years. Other conditions that must be met: at the respective company there is no other foreigner who has obtained a right of residence for this purpose, and the company has made a capital contribution or technology transfer of at least 50,000 euros.
For long-term medical treatment
If you are undergoing long-term medical treatment in public or private medical institutions, you must submit a letter of acceptance from those institutions stating the diagnosis and duration of treatment. An accompanying person may also be with you to assist you if you are unable to take care of yourself, but only if this is expressly stated in the acceptance letter.
